Waiver

By entering the premises of The Clubhouse Golf & Entertainment and/or participating in any activities, including but not limited to the use of golf simulators, clubs, balls, launch monitors, hitting mats, furniture, food and beverage areas, alcoholic beverages, and all related equipment and facilities (collectively, the “Activities”), you acknowledge, understand, and agree as follows:

Assumption of Risk

1. You understand that the Activities involve inherent and foreseeable risks, including but not limited to being struck by golf balls, golf clubs, or equipment; slips, trips, and falls; impairment due to alcohol consumption; equipment malfunction; and the actions or negligence of other participants. You knowingly and voluntarily assume all such risks, whether known or unknown, inherent or otherwise.

Alcohol Consumption Acknowledgment

1. You acknowledge that the consumption of alcohol may impair judgment, coordination, reaction time, and physical ability. You voluntarily assume full responsibility for the decision to consume alcohol, the amount consumed, and any consequences arising therefrom, including injury to yourself or others, property damage, or legal consequences.

Release and Waiver of Liability

1. To the fullest extent permitted by law, you hereby irrevocably release, waive, discharge, and covenant not to sue The Clubhouse Golf & Entertainment, its owners, officers, employees, contractors, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, costs, or expenses of any kind arising out of or related to your presence on the premises, participation in the Activities, or the consumption of alcohol, including any claim based on the alleged negligence of the Released Parties.

No Duty to Monitor or Limit Alcohol Consumption
You acknowledge and agree that the Released Parties have no duty to monitor, control, limit, or prevent your consumption of alcohol or to determine your level of intoxication, fitness to participate, or ability to safely remain on the premises.

Transportation Responsibility
You accept sole responsibility for securing safe transportation to and from the premises for yourself and any guests. The Released Parties shall have no responsibility or liability for any injury, accident, damage, or loss occurring after you leave the premises, including incidents related to driving or transportation.

Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, judgments, fines, penalties, costs, or attorneys’ fees arising from your participation in the Activities, your consumption of alcohol, your violation of any rules or instructions, or your conduct while on the premises, including injury to others or damage to property.

Responsibility for Guests and Minors
You accept full responsibility for the conduct and supervision of any guests or minors accompanying you. You represent and warrant that no minor in your party will consume alcohol and that you have the authority to agree to this waiver on behalf of any minor in your care, to the fullest extent permitted by law.

Use of Equipment and Compliance with Rules
You agree to use all equipment only as intended, to follow all posted rules and verbal instructions from staff, and to immediately cease participation if instructed to do so. The Released Parties reserve the right to refuse service, suspend play, or remove any individual at their sole discretion without refund.

No Medical or Safety Guarantees

1. You acknowledge that the Released Parties make no representations regarding your physical fitness to participate or the safety of the Activities and that you are voluntarily participating at your own risk.

Severability and Governing Law
If any provision of this agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. This agreement shall be governed by and interpreted in accordance with the laws of the state in which The Clubhouse Golf & Entertainment operates.

Acknowledgment and Binding Effect
By entering the premises, making a reservation, consuming alcohol, or participating in any Activities, you acknowledge that you have read and understood this agreement, understand that you are waiving substantial legal rights, and agree that this waiver is binding upon you and your heirs, executors, administrators, and assigns.
